COST OF A SOLICITOR FOR APARTMENT PURCHASE

I know this is a really difficult call, cos how long's a piece of string, but are Turkish solicitors very very expensive?

For the purchase of an apartment, I've just had an extremely high quote - I even think an extra nought has been added by mistake, it's that high!  Or maybe I'm naive!!!!

It very much depends on what you are asking the solicitor to do for you and who they are and who you are. I would recommend you use a solicitor for this type of transaction.

We used a solicitor in Kas to complete (not draw up the contract) a property purchase for us, agree and make sure we got the proper TAPU documents, pay the correct Purchase Tax, deal with the Notary in Kas and some other things. The charge seemed very reasonable.

I have heard of very high (unreasonable) solicitor charges for dealing with a Turkish Will.

We bought through Kalkan Horizon, gave power of attorney to Soner, Lea drew up the contract and they didn't charge us.
They are honest, know what they are doing and will help all they can.

Like Wendy, we bought our re-sale apartment through a reputable agent, Blacklion, gave Power of Attorney to Sakir, who saw to all the legalities. The contract was drawn up by them with a copy in English and Turkish and was very easy to understand. We were taken to the Notary's office in Kas where a translator provided us with a copy of the Power of Attorney. All very simple and no need for a solicitor.

I agree that so long as the contract is drawn up by your agent (make sure in both languages) you don't necessarily need a solicitor, however I think it would be wise that, unless you had experience of property contracts or were a solicitor, you ought to get a turkish lawyer to review it before signing.

We have been told (by a lawyer) that unless you get a contract notarised (in Kas), it is not necessary binding on the vendor.

I do think you should use a turkish lawyer for completion and checking the title and TAPU, living permission, Purchase Tax etc.

Logically would you had over a wadge of cash for the purchase of a property to anyone in the UK without at least trying to safeguard yourself with proper legal representation
So why oh why do it here ???

I agree with kevincat. Why would anyone try cutting corners on a property sale abroad. We bought in Kalkan 5 years ago and employed a London Solicitor who specialised in overseas purchases, with a dedicated solicitor for the country you bought in. Yes it was relatively expensive but well worth the peace of mind. They checked absolutely everything. No one would contemplate a house purchase in England without an independent solicitor, I would suggest to proceed with even more caution in Turkey.

We have done both!

Our first purchase was very straightforward and was handled from start to finish by our agent (Arif at Vesta Homes), who did a perfectly good job for us and was extremely helpful.

Our second purchase was more complicated as we had to check out various matters relating to rights of way, etc, so we used a solicitor (Alev in Kas). She was very good, and definitely worth her (reasonable) fee.

I think it's a case of horses for courses. I wouldn't buy off-plan anywhere without using a solicitor to make sure there was adequate planning permission etc. but would be less worried about buying an existing property where we know the owner and the history.

On that point, we are also buying an off-plan apartment in Italy, using a London-based international law firm; it has been an extremely painful (and costly) experience and makes buying in Turkey look like a walk in the park in comparison!

Even on an existing property, I would still check it the proper planning consents when it was built. c f problems in Spain !!!!
I have heard of properties being build in Kalkan that did not comply with their planning approvals.

Possibly not the same firm; this one has now vacated the London office and is based in Palermo. Yes.... Palermo in Sicily. Oh dear - "Family" trouble ahead, possibly... let's not go into that here though!

Have recently heard of a new solicitor who has opened for business in Kas. I have not used him myself, but had a brief talk with him. His English is good, but his prices are really good. From what I can gather, half the price of Kalkan's finest.
He's new, so he wants to be known and recommended, therefore he's out to do a good job.

A contract is important in theory, but has anyone here ever tried to take someone to court over a breach of contract? !  It's nearly impossible, horribly expensive and takes many, many years.

But it's very important to make sure the land and the building have the proper permissions and no debts are owed on either.

The best advice you can get is free and comes from the Turkish Embassy in London. It's here:

Hiring a UK solicitor means paying 2 solicitors: the one in the UK and his counterpart here in Turkey who will actually look at the legal documents and do the research. 

Therefore, IMHO, you will do better to go directly to a Turkish lawyer NOT from the same town where you're buying property, thus reducing the chances of a conflict of interest.

Hi, I moved my business here in Kalkan after 9 years working in the Mediterranean region. I sold many properties in Kalkan. I strongly recommend to use a solicitor all the time, especially n Kalkan. Reason being the sales contracts are not legal if not prepared by solicitors. I have an agreement with a solicitor in Fethiye (45 min. from Kalkan) she does contracts, does applications for military, gets your deed, electric and water subscriptions only for £750 and she is recommnended by UK Embassy in Turkey. If necessary she can also travel to Kalkan.

The post from KEP is incorrect. The British Consulate (there is no such thing as the UK embassy) does NOT recommend any solicitor.

It will provide a list of local solicitors upon request but no recommendation is made nor is inclusion on the list in itself a recommendation. It is up to the customer to do some homework and decide whether or not the solicitor is professional, reliable and offers value for money.

It would be wise to check the price of several solicitors before entering into contractual arrangements and be particularly cautious in dealing with anybody claiming to be recommended by the UK embassy.
