Sad I know but I know the official answer to this one.

McVitie''s classed its Jaffa Cakes as cakes, but in 1991, this was challenged by HM Customs and Excise in court. This may have been because Jaffa Cakes are about the same size and shape as some types of biscuit. The question which had to be answered was what criteria should be used to class something as a cake or biscuit. McVitie''s defended the classification of Jaffa Cakes as a cake by producing a giant Jaffa Cake to illustrate that their Jaffa Cakes were simply mini cakes.
They also argued that the distinction between cakes and biscuits is simply that cakes go hard when stale, whereas biscuits go soft. It was demonstrated that Jaffa Cakes become hard when stale and McVitie''s won the case.

Kalkanfan - did the question arise because cakes or biscuits are taxable?  ie one is and one isn''t!

Cakes were zero rated for VAT purposes as they were confectionary whereas biscuits did not qualify for zero rateing.  Customs tried to argue that Jaffa cakes were chocolate coated biscuits and therefore subject to the standard rate of VAT.

Excuse me, but I started this post!!! I have tried to establish if Jaffa cakes go hard when they are stale, but have always  eaten them all long before then.
So how about a few other trivial type questions?

Forgive me, but I am suffering from hard cheese and sour grapes!!!
I thought the question would start a lively but fun thread and am disappointed because Kalkanfan spiked my guns with the answer, and then got the credit.
I will sulk with a box of Jaffa Cakes and I will not be sharing them with any one ''cos they are mine, all mine.!!!!!

Personally, I consider it to be a cake.
And i like to nibble around the edges then remove the orangey slice from the base and eat them seperately.
Thats when im not troughing them down quick so i get the larger share!  ;)

this M&S battle has been going on for a while, but the treasury were insisting they wouldn''t reimburse the company as customers had paid...it''ll be intersting to know the outcome.
Incidentally if M&S chocolate teacakes and Jaffa Cakes are classified as "cakes" why are they to be found in the biscuit aisle in store??  ;)
I bet you all look next time you''re in M&S or Tesco... ;D
(apologies to those who can''t get to M&S or Tesco (with a "c") because you live in the most beautiful village in Turkey :P)

I''ve been reliably informed by my very health conscious son that eating Jaffa Cakes by the box is perfectly acceptable, cos after all, they only have 1g of fat.  Hahaha

Mr B always insists that a Jaffa cake is one of his five daily portions of fruit, so if he eats 10 then he''s done a good deed for two days in one go!!  ???

I must admit to a weakness for M&S choc teacakes..especially as you can get twenty in a pack for 99p when thy are on special offer!!! ;D

On the contrary, Feds, M&S have actually increased the cost of their teacakes..now when there''s a special offer you get 16 for £1.20 when it used to be 99p...all those 21p''s add up, you know....cm''on M&S pass your windfall on to customers who actually bought the teacakes in the first place!!! Like me... :laugh:
