Title: Turkish Will

This week, went to Fethiye to make our Turkish Wills and thought I would share our experience of doing it. Simples really !!

Anyone owning immovable assets (e.g.property) in Turkey should have a Turkish Will that sets out their clear inheritance intentions. Turkey has intestate rules that may not suit you !

You need an english speaking Turkish lawyer in Fethiye we saw recommended on EK. Excellent service, I can recommend if you PM me and I will give you their details.

Anyway this is how it went:

1 hour meeting to discuss procedure and to explain what we wanted in the Will. They need clear instructions from you.

A break (lunch time) while they prepare the document.

We then went back to their office and they took us to the Notary's office across the street. The Notary put the Will terms on to the official document including an english translation. We checked it before signing the Will. It then required two witnesses, who we did not know, but our lawyer arranged them to come in and sign the Wills as witnesses. It was then all signed and stamped by the Notary.

It took an hour or so at the Notary's office to do this as we had to wait for the witnesses to arrive.

Very simple and straight forward.

Cost per Will:
Lawyer Fee TL 200
Witness fee TL 10 X 2
Notary Fee TL 273
Total of TL 493 or about £200

Contrary to what we were initially told, you don't need to get a medical certificate at a hospital to prove you are of 'sound mind' !!!

Thank goodness you don't need the "sound mind certificate" otherwise Mr Lizard would never be able to make a will.

On a more serious note we to have done our wills (in Kas) and its a very sensible thing to do even if you are married and have an English will apparently the Turkish intestate rules take for ever to sort out.

If you make an English will after making your Turkey will it musn't have the normal wording which says that it replaces all previous wills or the Turkish one becomes obsolete. It needs to say 'all previous wills except the one made and notorised in Turkey'.

That's funny, because we did. The test, performed by a consultant at the hospital, went something like:

Consultant (to me, pointing to Fiona): "Is this your wife?"
Me: "Yes"
Consultant: "Why did you marry her?"
Me: "Because she is beautiful"
Consultant: "You passed the test"

I won't tell you how he assessed Fiona's mental health (but she is blonde)!

When I had my medical, the GP in Kalkan did not even see me. A certificate is about 30 lira I think, and you hand the money over to one of the nurses, and that is it!
