Making a Turkish Will
« on: June 05, 2012, 05:28:30 PM »
Hi there
My husband and I are visiting Kalkan soon and would like to make arrangements for making our wills as we own property and have a local bank account. Has anyone been through this process recently and can offer any advice with a rough idea of the costs involved?
Have you used a solicitor in Kalkan or is it best to travel to Fetihye? I have seen from older threads that Everything Legal in Fethiye have been recommended. Can the process be completed in a day as I see that you have to obtain a doctors certificate.
Any advice would be appreciated.

I heard a rumour you need residency for the will to be declared valid especially if this relates to property... anyone know if this is true?

Don't think the residency thing is true. We made our wills a few years ago at everythinglegal (all done in a few hours and registered with the notary).

We too used Everything Legal in Fethiye a few years ago.  As Kalkan regular says everything completed in a day and no doctors certificate required.

If you have property in Turkey, a Turkish will is very advisable.

Two words of caution from a non-lawyer :-

1.  Make sure that any will you have in the UK or elsewhere, excludes property in Turkey so that there are no conflicts of intention.
2. Beware that under Turkish Law any male descendants can make a claim against your estate regardless of whether they are mentioned in the will or not - and that can include step sons.  If this might happen consider transferring title to the people that you want to inherit whilst you are still around.

There was a recent article in a local kalkan publication written about having a turkish will. For me it raised more questions than it answered. It appears that despite having a turkish will, turkish law stipultes specific spilts of your estate, irrespective of what you have in your will.
Make sure you a 100% clear on what will happen to your estate when you pop off otherwise, don't bother.

Just to add to confusion there was a mention on Fethiye news that UK wills will be recognized in Turkey soon.

just to add to the discussion, i understand that you need a turkish will if you have a turkish bank account. this is independent of owning property. without a will any monies in turkish bank account cannot be included in your uk will as part of your estate, should you die. i am about to open a bank account this year so i need to get clarification on this. anyone know for sure the law as it stands at present.

not planning on departing anytime soon, but..... if i become an angel
